Banking Terms and Conditions

ONLINE AND MOBILE BANKING TERMS AND CONDITIONS AGREEMENT EFFECTIVE

PLEASE READ AND REVIEW THESE TERMS AND CONDITIONS AGREEMENT CAREFULLY. BY ACCESSING THIS SITE AND ANY PAGES THEREOF, AS WELL AS THE APP, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS BELOW. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS BELOW, DO NOT ACCESS THIS SITE, OR ANY PAGES THEREOF NOR THE APP. YOUR ELIGIBILITY FOR PARTICULAR PRODUCTS AND SERVICES IS SUBJECT TO FINAL DETERMINATION BY BANCO SAN JUAN INTERNACIONAL(BSJI).

SECTION I               INTRODUCTION

General information

This Online and mobile Banking Terms and Conditions Agreement ("Agreement") is a contract between you and Banco San Juan Internacional that outlines and governs the Terms and Conditions for accessing your personal and commercial accounts via Banco San Juan Internacional Online Banking Service. This Agreement explains the terms and conditions which govern the Online and mobile Banking Services offered via Banco San Juan Internacional (BSJI) Online Banking Service.

Use of the Banco San Juan Internacional(BSJI) Online and Mobile Banking Service or any of the Services, is expressly conditioned upon your acceptance of the terms and conditions of this Agreement. By clicking on the "I Agree" button at the end of this Agreement or using the Banco San Juan Internacional Online and Mobile Banking Service or any of the Services, you agree to abide by all the terms and conditions of this Agreement and acknowledge you received them and understanding of this Agreement. Please read this Agreement carefully and print a copy for your records. This Agreement is governed by federal laws and regulations and, to the extent not preempted by federal law, by laws and regulations of the Commonwealth of Puerto Rico.

This Agreement supplements our applicable disclosure statements and agreements, including, but not limiting, our Demand Deposit Account Agreement, Schedule of Fees, Privacy Disclosure and Security Statement, in effect, from time to time.  In the event that any provision of this Agreement conflicted with the terms contained in such disclosure statements and agreements, this Agreement shall prevail, to the extent necessary.

Definitions

“Banco San Juan Internacional(BSJI)”: Means the Banco San Juan Internacional(BSJI), Inc.

“Consumer Accounts”: Some of the terms set forth in this Agreement, apply only to Consumer Accounts. A "Consumer Account" is an account held by a natural individual and used primarily for personal, family or household purposes.

“Business Days”: The term "Business Day" refers to Monday through Friday, excluding federal banking holidays.

“Services” or “Online and Mobile Banking Services”: Refers to the following banking services that will be provided through Banco San Juan Internacional Online and Mobile Service:  Account and Balance Inquiries, Account Transfers, Transaction Downloads and estatements, and any other Online and Mobile services to be offered by Banco San Juan Internacional in the future in accordance with the terms of this Agreement..

“Site or Web Site  and App”: Means the Web site and App owned or operated by Banco San Juan Internacional(BSJI), Inc. through which Banco San Juan Internacional(BSJI) Online and Mobile Banking Service is provided.

 

SECTION II              ACCESSING YOUR ACCOUNTS, SECURITY AND YOUR RESPONSIBILITIES

Access requirements

To Access Online Banking or Mobile Banking, you must use a personal computer or a mobile device with internet access and make sure that the operating system versions are supported by the manufacturer.

Any current functionality on a different configuration may be diminished or eliminated in future updates to the Banco San Juan Internacional Online and Mobile Banking.  From time to time the hardware and/or software requirements to use the Banco San Juan Internacional Online and Mobile Banking may change.

If you were to access Banco San Juan Internacional(BSJI) Online and Mobile Banking using any non-supported internet browser, such use shall be at your own risk, and you, and Banco San Juan Internacional shall not be liable for any losses resulting from such use. You are responsible for obtaining, installing, maintaining and operating all software, hardware and other equipment necessary to access and use the Banco San Juan Internacional(BSJI) Online and Mobile Banking, including, without limitation, antivirus, anti-spyware and internet security software. You are also responsible for any and all fees imposed by any internet service provider or communications service provider.

You acknowledge the security risks of transmission errors, corruption, and access availability associated with the use of open networks, such as the internet; and by way of this expressly assume said risks.

You agree that Banco San Juan Internacional(BSJI) is not responsible for any errors or problems that may arise from the malfunction or failure of your computer or Mobile Device, internet service provider or other systems, any virus, worm, or other problem that may enter your computer or mobile device by downloading information or materials from, or otherwise related to your use of the Banco San Juan Internacional(BSJI) Online and Mobile Banking. You further agree that Banco San Juan Internacional(BSJI) is not responsible for notifying you of any upgrades, fixes or enhancements to, or for providing technical support or other support for your systems.

Password and login security

Security is very important to Banco San Juan Internacional(BSJI). In order to activate your Banco San Juan Internacional(BSJI) Online and Mobile Banking, you must have at least one checking, savings, certificate of deposit or loan account with Banco San Juan Internacional(BSJI). When you login to the service for the first time, you will receive an email containing your username and configuration link. You will then be prompted to complete the registration and configuration of your user account and "password". Being that your Access Information is used to access your accounts, you should treat it as you would any other sensitive personal data. You should carefully select a Password that is hard to guess. Keep your Password safe. Memorize your Password and never tell it to anyone. You should not under any circumstances disclose your Password by telephone or to anyone claiming to represent Banco San Juan Internacional. Bank employees do not need and should not ask for your Password.

Banco San Juan Internacional(BSJI) is entitled to act on instructions received through Online and Mobile banking under your Password and other Access Information and without inquiring into the identity of the person using that Password or such other Access Information. Any person having access to your Banco San Juan Internacional(BSJI) online and mobile banking Password or other Access Information will be able to access the Online and Mobile Banking Services and perform all transactions, including reviewing account information and making transfers to other accounts which have mutual ownership. You are liable for all transactions made by persons authorized to use your Password or other Access Information.

You give consent to the person whom receives your username and password for your online and mobile banking, that by being in possession of the email for account administration, they may make transactions with the approval of all the signatories. Banco San Juan Internacional(BSJI), Inc. will not be responsible for the operations made by the administrator of the account, due to the full acknowledgement all signatories have of said authorization.

If, despite the Bank's advice, you give your Password to anyone, you do so at your own risk since anyone to whom you give your Password or other Access Information will have full access to your account(s) even if you attempt to limit that person's authority.

We strongly urge you to change your Password every 120 days. This can be done at any time once you are logged in, from the "Help and Support" menu.

  • This is the criteria to be followed for passwords:

                    - Must contain minimum of eight (8) alphanumerical characters.

                     - Must contain maximum of sixteen (16) alphanumerical characters.

                    - Must contain at least one (1) of the following special characters (= * _ . - ).

  • Passwords are case sensitive (must be entered exactly as set with upper and/or lower case characters).

  • Passwords can be changed at any time by the account holder, and by any other person to whom the account holder provides the password, through the Banco San Juan Internacional(BSJI) Online. or Mobile Banking.

If you suspect that an unauthorized person has access to your Password or believe your Password or other Access Information has been lost or stolen or that someone may attempt to use the Services without your consent or has transferred funds without your permission, your must notify Banco San Juan Internacional(BSJI) immediately. We reserve the right, under certain circumstances, to deny your access to any one or more accounts(s), the Banco San Juan Internacional Online and Mobile Banking, or any of the Services, or to deny the processing of transactions if we reasonably believe your Access Information has been compromised in any way or is being used, or might be used, by any unauthorized person(s). For Business Customers, you agree to immediately notify us if a person with Access Information leaves your employment. See Part V of this Agreement for additional information relating to liability for unauthorized transactions and error resolutions. Your session time is unlimited, but to help prevent unauthorized access and ensure the security of your accounts, we will end your online session if we have detected no activity for five (5) minutes. This is to protect you in case you accidentally leave your computer or your mobile devise unattended after you login. When you return to your computer or mobile devise, you will be prompted to re-enter your Password and your session will continue.

Your rights and responsibilities

In addition to this Agreement, you agree to be bound by and comply with the Demand Deposit Account Agreement signed by you and with Puerto Rico and federal laws and regulations. You are responsible for keeping your Access Information and account data confidential. We are entitled to act on transaction instructions received using your Password, and you agree that the use of your Password will have the same effect as your signature, authorizing the transaction(s). If you authorize other persons to use your Password in any manner, your authorization will be considered unlimited in amount and manner until you have notified us in writing that you have revoked the authorization, changed your Password, and that you are responsible for any transactions made by such persons and we have had sufficient time to act upon the notification that transfers by that person, or instructions regarding your accounts, are no longer authorized.

 

SECTION III             ONLINE AND MOBILE BANKING SERVICES AND LIMITATIONS

Available services

The following Services will be provided without additional monthly charge:

  • View account balances and transaction history.

  • Transfer funds from your Banco San Juan Internacional(BSJI) checking and savings accounts into:

                       - Other Banco San Juan Internacional(BSJI) checking and savings accounts that belong to you.

                       - Make payments to loans with Banco San Juan Internacional(BSJI).

  • Establish automatic transfers from one of within Banco San Juan Internacional accounts (from checking and savings to checking, savings or loans).

  • Receive monthly statements.

  • Communicate directly with Banco San Juan Internacional(BSJI) via e-mail.

Other services may be added to Banco San Juan Internacional(BSJI) Online and Mobile Banking Services and will be communicated to our customers as the additions are made, for said services a fee may be charged.   Also, there may be a charge in connection with your use of some of the features available through the Banco San Juan Internacional Online and Mobile Banking (i.e. if you request a stop payment of a check).

Please refer to the Schedule of Fees applicable to your account(s) for more information.

Hours of accessibility

You may access Banco San Juan Internacional (BSJI) Online and Mobile Banking Service seven days a week, 24 hours per day. Necessary system maintenance will be scheduled for hours during which system traffic is normally at a minimum. If the system is unavailable due to an unanticipated problem, you may contact us at +1 787 767-2605 or you may visit our offices at Galería San Patricio, B5, Calle Tabonuco, Suite #207, Guaynabo, Puerto Rico 00968-1235 (during business hours) to perform your transactions.

Balance and transaction information

You may access any eligible Banco San Juan Internacional(BSJI) account on which you are a holder or signer to receive transaction history and balance information. The balance and account history will show the account balance including transactions conducted prior to the inquiry. "In progress returns" due to non-sufficient funds or "stop payments" may not be reflected in the inquiry. Account information provided to you as part of the Banco San Juan Internacional Online and Mobile Banking is not the official record of your account(s) or its activity.  Your account(s) statement will remain the official record of your account(s).  Your obligations regarding review of your account(s) statement are set forth in Part V of this Agreement.

Funds transferred between related accounts initiated on your computer or mobile device using Online Banking or Mobile banking and received by the bank before 4:00 p.m. ET on a Business Day will be effective on that Business Day. Transfers processed on your computer or mobile devise using Online or mobile Banking and received after 4:00 p.m. ET on a Business Day, or on any non-Business Day, will be effective the following Business Day.

Unavailable, delayed, or inaccurate account information

We strive to provide complete, accurate and timely account information through the Online and Mobile Banking Services. However, unless otherwise required by law, we will not be liable if any such information is unavailable, delayed or inaccurate. With respect to electronic funds transfer problems, such as unauthorized transfers or the Bank's failure to properly complete authorized transfers, the extent of our liability is described in Part [VII] of this Agreement.

Limits on frequency and amount of transfers

Federal regulations require us to limit either by contract or in practice the number of certain types of transfers from money market deposit accounts and savings accounts if any such accounts are available to our customers. Under these regulations, you are limited to six (6) preauthorized electronic fund transfers each month, including telephone transfers. and other online and mobile banking transactions, checks, and point-of-sale transactions. Of these six transactions, you are limited to no more than three transactions per month by check or Point Of Sale. Payments to your Banco San Juan Internacional loan accounts are not acounted toward this limit. Subject to availability of funds in your designated checking account, there are no limits on the dollar amount of transfers to or from your account.

Service cancellation

Banco San Juan Internacional (BSJI) reserves the right to cancel your Online and Mobile Banking Services at any time without notice due to insufficient funds in one or more of your accounts. After cancellation, service may be reinstated at the discretion of the bank provided that funds are available to cover the cost of any fees and/or pending transfers. To reinstate your Services, contact Banco San Juan Internacional (BSJI) Online and Mobile Banking Department at +1 787 767-2605. If you wish to cancel any of your Online or Mobile Banking Services, please contact Banco San Juan Internacional (BSJI) Online Banking Department at +1 787 767-2605 or send us cancellation instructions in writing to: Banco San Juan Internacional (BSJI)-Online and Mobile Banking Department, Galería San Patricio, B5, Calle Tabonuco, Suite #207, Guaynabo, Puerto Rico 00968-1235.

 

SECTION IV             CHANGES TO FEES, CHARGES AND OTHER TERMS

We reserve the right to change any fee, charge or other term outlined in this Agreement. We will notify you prior to implementation of changes, either by written notice or e-mail. In the event that a change is necessary to ensure the security of the online system, and mobile systems, an immediate change may be necessary, and we may notify you after the change has been made by electronic or written notice. You may choose to accept or decline changes by continuing or discontinuing the Services to which the changes relate. We reserve the option to waive, reduce or reverse charges or fees in individual situations. Changes to fees applicable to specific accounts are governed by the terms and conditions of the specific account.

SECTION V               ADDITIONAL ELECTRONIC FUND TRANSFER DISCLOSURES AND AGREEMENT TERMS

Unauthorized transactions

Tell us IMMEDIATELY if you believe your Password for the Online or Mobile Service has been lost or stolen or if you believe that your Password may have been used without your permission. You can call us at +1 787 767-2605 on regular business hours, in cases of troubleshooting with the Ping or code of the credit card. You may also write to: Banco San Juan Internacional (BSJI) Galería San Patricio, B5, Calle Tabonuco, Suite #207, Guaynabo, Puerto Rico 00917-00968.

You could lose, under certain circumstances, the total amount of funds deposited in your account, plus your maximum line of credit. The fastest way to notify the Bank and reduce any possible losses is through a telephone call.

The following three paragraphs apply only to Accounts that are "Consumer Accounts" (as defined in the Introduction to this Agreement):

If you inform us within two Business Days (see above for our Business Days), you could lose no more than $50 if someone used your online or mobile password without your permission. If you do NOT inform us within two Business Days after you learn of the loss or theft or unauthorized use of your password, and we can prove that we could have stopped someone from using your password without your permission if you had told us, you could lose as much as $500.

If your statement shows transfers that you did not make, tell us at once. If you do not notify us within sixty (60) days after your statement was mailed to you, you may not get back any amount of the loss after the sixty (60) days if we can prove that we could have stopped someone from taking the money if you had told us in time.

If a good reason, such as a confirmed extended trip or hospital stay, kept you from informing us, we will extend the time periods.

Contact in event of unauthorized transfers

If you believe your Password or other Access Information for the Online and Mobile Banking Services has been lost or stolen or that someone has transferred or may transfer money from your account without your permission, call Banco San Juan Internacional (BSJI) Online and Mobile Banking Department at +1 787 767-2605 or you can write to our email operaciones@bsji.com.

In case of errors or questions about your electronic transfers, call us, email us, or write to us at the telephone number, email address or office address provided in the paragraph above. Contact us as soon as you can if you think your statement or receipt is wrong or if you need more information about a transfer listed on your statement or receipt. We must hear from you no later than 60 days after we delivered you the FIRST statement on which the problem or error appeared. When you contact us about your problem (including by telephone, email or fax), please:

  • Include your name and account number(s).

  • Describe the error or transaction in question, and explain why you believe it to be an error.

  • Tell us the dollar amount of the suspected error.

  • If the problem involves a bill payment, tell us the checking account number used for payment, the payee's name, date for which the payment was scheduled, payment amount, and any applicable payee account number or reference number.

If the notification is made orally, we may require that you send us your complaint or question in writing within 10 Business Days.

The following three paragraphs apply if your complaint or error is with regard to a Consumer Account:

We will determine whether an error occurred within 10 Business Days after we hear from you and correct any error promptly. If we need more time, however, we may take up to 45 calendar days to investigate your complaint or question. If we decide to do this, we will provisionally credit your account within 10 Business Days for the amount you think is in error, so that you will have the use of the funds during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within 10 Business Days, we may not provisionally credit your account.

For errors involving new accounts, Points Of Sale, or foreign-initiated transactions, we may take up to 90 days to investigate your complaint or question. For new accounts (an account that has been opened for 30 days or less), we may take up to 20 Business Days to provisionally credit your account for the amount you think is in error.

We will tell you the results of our investigation within three Business Days after completing our investigation. If we decide that there was no error, we will send you a written explanation. You may ask for copies of the documents we used in our investigation.

Our liability for failure to make transfers or late payments

If we do not complete a transfer to or from your bank account on time or in the correct amount according to our agreement, and if the transfer was to or from a Consumer Account, we will be liable for your losses or damages. However, there are some exceptions. We will not be liable:

  • If, through no fault of ours, you do not have sufficient funds in your account to make a transfer or bill payment.

  • If a legal order directs us to prohibit withdrawals from the account.

  • If your account is closed or if it has been frozen.

  • If a hold has been placed on your account for uncollected funds.If the transfer or payment would cause the account to become overdrawn beyond the balance of the account plus any overdraft protection.

  • If you, or anyone you allow, commits fraud or violates any law or regulation.

  • If any electronic terminal, telecommunication device or any parts of the electronic fund transfer system is not working properly.

  • If you have not provided us with complete and correct payment information, including but not limited to the name, address, account number and payment amount of the payee on a bill payment.

  • If you have not properly followed the instructions for using Banco San Juan Internacional(BSJI) online and mobile banking Bill Payment Service.

  • If circumstances beyond our control (such as fire, flood, hurricane, improper transmission or handling of payments by a third party) prevent the transfer or bill payment, despite reasonable precautions taken by us.

  • There may be other exceptions stated in the Demand Deposit Account Agreement signed by you.

  • There may be other exceptions established on the savings account agreement you have subscribed.

Confidentiality -- Disclosure of account information

You authorize Banco San Juan Internacional to disclose to third parties, agents, and affiliates, such as independent auditors, consultants or attorneys, information you have provided that we have obtained about your accounts and the transfers you make:

  • To comply with government agency requests or court orders.

  • To verify the existence and condition of your account to a third party, such as a credit bureau or merchant.

  • To provide services relating to your account or to offer other products and services.

  • To other entities if you give us permission.

Preauthorized credits/Deposits

If you have arranged to have direct deposits made to your account at least once every 60 days from the same person or company the person or company making the deposit will notify you every time they send us the funds OR you can call us at +1 787 767-2605 to confirm the deposit.

Fees and charges

Any applicable service fee will be based on the current Banco San Juan International(BSJI) Service Schedule of Fees which will be available and posted in our Webpage.

You agree to be responsible for any local or long distance telephone charges or Internet Service Provider (ISP) charges that you incur by accessing your accounts via Banco San Juan Internacional(BSJI) Online and Mobile Banking.

SECTION VI              STATEMENTS

You agree to receive your electronic account statements periodically via online Banking and Mobile Banking.

You agree, as well, to receive online any legal notifications or other information that may affect your account (s) including, but not limited to, account agreements, costs programs, privacy and any other regulatory notifications and amendments to to any of said documents. You must connect to online banking or Mobile Banking, using your account ID and password to check your account statements and/or any other notification.

There will be a PDF version of your account Statement available. Your Periodic Account Statement PDF will be your Legal Statement. To see your account statements, you need updated Adobe Acrobat Reader or any other program with PDF reading capability. You may get Adobe Acrobat Reader free of charge at www.adobe.com/acrobat. To print and retain a paper copy of your account statements, you will need a linked printer to your computer.

Statements may only be accessed through Banco San Juan Internacional Online and Mobile Banking Service. When your Statements are available, you will receive an email notification to the email address you have on file with Banco San Juan Internacional.  Any account statement posted will be considered delivered on the day that it was first made available to you for viewing. If your email notification is returned to us as undeliverable, we may discontinue the Statements Service and mail your periodic account statements in paper form to your current mailing address on file via U. S. Mail. There will be a charge in accordance with the applicable Schedule of Fees for subsequent paper statements. Regardless of your reception of email notification, you agree that our posting of your statements on the Online or Mobile Banking site or app constitutes delivery of your periodic account statement. You agree to log onto Online or Mobile Banking site or app at least once a month to review your statements. You agree to provide Banco San Juan Internacional with an email address in order to receive your email notifications. It is your responsibility to ensure that Banco San Juan Internacional has your correct email address. If your email address changes, you must provide us with your new email address by contacting us in writing at the address listed below, or by contacting one of our Customer Service Representatives, in person.

You may request a paper copy of any statement or other information received electronically under this Agreement by writing to us at the following address: Galería San Patricio, B5, Calle Tabonuco, Suite #207, Guaynabo, Puerto Rico 00968-1235. We will charge a fee for each paper statement copy you request. You may also contact one of our Customer Service Representatives, in person.

SECTION VII             LIMITATIONS ON BANK LIABILITY AND INDEMNIFICATION

We will not be responsible for the following incidents, errors or failures:

Acces

We will not be responsible for failure to provide access or for interruptions in access to Banco San Juan Internacional(BSJI) Online Mobile Banking systems or any Service provided through it due to a system failure or due to other unforeseen acts or circumstances.

Your Computing equipment, mobile device or program 

We will not be responsible for any errors or failures from any malfunction of your computer or Mobile devise, Computer virus or any other problems related to your computer or Mobile equipment used with Banco San Juan Internacional Online and Mobile Banking. We are not responsible for any error, damages or other losses you may suffer due to the malfunction or misapplication of any system you use, including your browser (Microsoft Explorer®, or otherwise), your Internet Service Provider (ISP), your personal financial management or other software, (such as Quicken®, or Microsoft Money®), or any equipment you may use (including your telecommunications facilities, computer hardware and modem) to access or communicate with Banco San Juan Internacional Online and Mobile Banking.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE BANCO SAN JUAN INTERNACIONAL(BSJI) ONLINE AND MOBILE SERVICE AND OR ANY OTHER SERVICES IS AT YOUR OWN RISK.  THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.  WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND RELATING TO THE SERVICES, WHETHER EXPLICIT OR IMPLIED INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND ANY IMPLIED WARRANTIES ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE.

WE MAKE NO REPRESENTATION OR WARRANTY THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS, OR THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE.

WE FURTHER DISCLAIM ANY REPRESENTATION OR WARRANTY THAT ANY ERRORS IN TECHNOLOGY WILL BE CORRECTED.  ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICES IS OBTAINED AT YOUR OWN DISCRETION AND RISK, AND WE ARE NOT RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER OR MOBILE DEVICE SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL, WHETHER DUE TO COMPUTER OR MOBILE DEVICE VIRUS OR OTHERWISE.  WE MAKE NO REPRESENTATION OR WARRANTY AS TO THE COMPLETENESS, ACCURACY OR RELIABILITY OF ANY THIRD PARTY INFORMATION OR DATA THAT YOU OBTAIN THROUGH THE USE OF THE SERVICES.

WE MAY PERIODICALLY AMEND, ADD, DELETE, UPDATE OR ALTER THE SERVICES INCLUDING, WITHOUT LIMITATION, THESE TERMS AND CONDITIONS.  EXCEPT AS OTHERWISE REQUIRED BY APPLICABLE LAW, WE ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY ERRORS OR OMISSIONS IN THE CONTENT OF THE SITE AND WE SPECIFICALLY DISCLAIM ANY DUTY TO UPDATE THE INFORMATION ON THE SITE.

YOU AGREE THAT NEITHER WE NOR ANY OF OUR OFFICERS, DIRECTORS, EMPLOYEES, SHAREHOLDERS, PARENTS, SUBSIDIARIES, AFFILIATES, AGENTS OR THIRD PARTY SERVICE PROVIDERS WILL BE LIABLE OR ANY THIRD PARTY FOR ANY SPECIAL, INCIDENTAL, DIRECT, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING BUT NI LIMITED TO, LOST PROFITS EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, WARRANTY, DAMAGES, STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR ACCESS TO OR USE OF THE SERVICES OR THE INABILITY TO ACCESS OR USE THE SERVICES.THIS SECTION SHALL SURVIVE TERMINATION OF YOUR USE OF THE SERVICES.

Indemnification

You acknowledge and agree that you are personally responsible for your conduct while using the Banco San Juan Internacional(BSJI) Online and Mobile Services and agree to indemnify and hold us and our officers, directors, employees, shareholders, parents, subsidiaries, affiliates, agents and third party service providers harmless from and against any losses, damages, liabilities, costs or expenses of any kind including, but not limited to, reasonable attorney’s fees, court costs and related litigation costs and expenses, that we may incur in connection with any third party claim or otherwise, arising out of or concerning your use of the Banco San Juan Internacional Online and Mobile Service or any of the Services provided through it by anyone using your Access Information, or your violation of this Agreement.  Your obligations under this section shall survive termination of this Agreement.

SECTION VIII            OTHER PROVISIONS

Electronic notice

With your consent, we may send notices to you by electronic mail (e-mail). You may use e-mail to contact us about inquiries, maintenance, and/or some problem resolution issues. E-mail may not be a secure method of communication. We therefore recommend that you do not send confidential personal or financial information by e-mail. There may be times when you need to speak with someone immediately, especially to report a lost or stolen PIN or to stop a payment. In these cases, do not use e-mail. Instead, call us at +1 787 767-2605 during regular business hours, Monday - Friday 8:30 a.m. - 5:00 p.m. excluding Bank Holidays.

Warranty of computer and app software limitations

NEITHER WE, NOR ANY OF OUR SUBSIDIARIES, ANY SOFTWARE SUPPLIER NOR ANY INFORMATION PROVIDERS MAKE ANY WARRANTY, EXPRESSED OR IMPLIED, TO YOU CONCERNING THE SOFTWARE, EQUIPMENT, BROWSER OR OTHER SERVICES INCLUDING, BUT NOT LIMITED TO, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR PARTICULAR PURPOSE (OR NON-INFRINGEMENT OF THIRD-PARTY RIGHTS), UNLESS DISCLAIMING SUCH WARRANTY IS PROHIBITED BY LAW.

Ownership of website and App

The content, information and offerings on our Website and App are owned by Banco San Juan Internacional(BSJI), and the unauthorized use, reproduction, linking or distribution of any portions are strictly prohibited.

Scope of agreement

This Contract represents our complete Agreement with you relating to our provision of Banco San Juan Internacional(BSJI) Online and Mobile Banking Service. No other statement, oral or written, including language contained in our Website or Mobile App, unless otherwise noted, is part of this Agreement.

Consignments

We may cede certain of its rights and responsibilities under this Agreement to independent contractors or other third parties.

Unlawful transactions

You agree not to use the Banco San Juan Internacional Online and/or Mobile App for any illegal or unlawful purpose.  You acknowledge and agree that we have no obligation to monitor or review your transactions for legality and that we may presume that all of your transactions are legal in all applicable jurisdictions. We reserve the right, however, to decline any transaction that we believe is an illegal transaction or a high-risk transaction in any applicable jurisdiction.  We are not responsible for the recovery or reimbursement to you of any funds transferred in connection with any transaction of this nature that is determined to be illegal. You further agree not to use your account or any of the Services to engage in any internet, online or mobile gambling transaction including, but not limited, to those activities prohibited by the Unlawful Internet Gambling Enforcement Act, 31 U.S.C. Section 5361 et. seq.  We reserve the right to decline any transaction that we believe is an internet, online or mobile gambling transaction.

Termination

We may terminate your use of the Banco San Juan Internacional(BSJI) Online or Mobile Banking, in whole or in part, at any time and for any reason without prior notice including, but not limited to, your failure to access the Banco San Juan Internacional Online or Mobile Banking for a period of three consecutive months or longer.

  • You may terminate your rights to use the Banco San Juan Internacional(BSJI) Online or Mobile Banking by notifying us in writing. You authorize us to continue making transfers, payments and other transactions you have previously authorized through the Banco San Juan Internacional(BSJI) Online or Mobile Banking until we have had a reasonable time to act upon your instructions.  It is your responsibility to cancel any recurring or future dated transfers prior to cancelling the Banco San Juan Internacional(BSJI) Online or Mobile Banking Service as these transfers will not be terminated unless you do so.  Notwithstanding the foregoing, all recurring transfers and payments must be cancelled prior to terminating the Banco San Juan Internacional Online and/or Mobile Banking Service.

  • Upon any termination you shall immediately discontinue use of the Banco San Juan Internacional(BSJI) Online. and/or Mobile Banking Service. Any termination shall not affect your liabilities or obligations under this Agreement for any transactions initiated prior to termination.

It is your sole responsibility to ensure that your contact information is current and accurate.  This includes, but is not limited to, your name, address, telephone numbers and email addresses.  Changes can be made through our Website or by contacting our Customer Service Representative. We are not responsible for any payment processing errors or fees incurred if you do not provide accurate contact or account information.

Amendment.

We may amend, revise or modify this Agreement at any time and from time to time at our own discretion.  Unless otherwise provided herein, we will post the amended terms and conditions on our Website together with a notice that this Agreement has been amended.  Any use of the Services following such notice will constitute your agreement to such change(s).  Further, we may, from time to time, revise or update the applications, services, and/or related material, which may render all such prior versions obsolete.  Consequently, we reserve the right to terminate this Agreement as to all such prior versions of the applications, services, and/or related material and limit access to only the most recent revisions and updates.

Waiver

Our failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provisions or rights.  Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement.  We shall not be deemed to have waived any of our rights or remedies hereunder unless such specific waiver is in writing and signed by us.  No delay or omission on our part in exercising any rights or remedies shall operate as a waiver of such rights or remedies or any other rights or remedies.  A waiver on any one occasion shall not be construed as a blocking or waiver of any rights or remedies on future occasions.

Governing law

This Agreement shall be governed by and interpreted in accordance with all applicable federal and Commonwealth of Puerto Rico laws, rules and regulations.

Severability

If any provision of these Terms and Conditions Agreement is determined to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of this Agreement will not be affected thereby, and each of those provisions will be valid and enforceable to the fullest extent permitted by law.

Caption headings and interpretation

The caption headings are for convenience or reference purposes only and are not to be construed as a summary of each provision of this Agreement.  Unless it would be inconsistent to do so, words and phrases used in this document should be construed so that the singular includes the plural and the plural includes the singular.
